Massachusetts Baristas Can Thank Strict Construction For $14M Extra In Tips

Starbucks said it was complying with Massachusetts state law in giving supervisors a share of tips because the supervisors spent up to 90% of their time doing the same work as baristas. A 1st Circuit opinion, affirming the trial court, ridiculed Starbucks' legal arguments, pointing out that Massachusetts law says tips are to be shared only among those with “no managerial responsibility."  "No means no" the opinion said.  Here it is (PDF).
