Gongwer News is reporting that the 6th Circuit Court of Appeals, sitting en banc, has overturned Michigan's voter-approved constitutional ban on affirmative action ("Prop 2") on the grounds that the ban violates equal protection. The four opinions (Coalition to Defend Affirmative Action v. Regents of the University of Mich.) are available here. The Free Press reports that Attorney General Bill Schuette said he will appeal the 8-7 decision.
