Court of Appeals Says Lawsuit On Michigan Indigent Criminal Defense Can Proceed
The up-and-down fortunes of a lawsuit
claiming that Michigan's indigent criminal defense system does not meet
constitutional requirements are up again, as a result of a Court of Appeals opinion
issued Tuesday sending the case back to the Ingham Circuit Court for discovery. Meanwhile, advocates for an improved indigent criminal defense system,
including the State Bar of Michigan, continue to press for reform legislation.
A bill to establish a Michigan Indigent Defense Commission passed the House
last fall but did not pass the Senate before the end of the legislative term.
