U.S. Supreme Court Decision On State Of The Union Address Attendance: 6-3 In Favor

Six Justices attended the State of the Union address.  From the majority decision (Roberts, Kennedy, Bader Ginsburg, Breyer, Sotomayor, Kagan):

 

Justice Scalia, who delivered a competing address across town, a "conversation" with Nina Totenberg at GWU, had the dissent on State of the Union addresses generally, with Justices Alito* and Thomas possibly concurring through their absences:

Juvenile spectacle. I resent being called upon to give it dignity.

*Justice Alito was in New Jersey on Monday for his mother's funeral.
